Such claims were challenging to the judicial orthodoxy of the time. Previous theories of crime were located in the Classical ideas of rational choice. Individuals have ‘free will’ and make choices based upon consequences. Lombroso’s approach suggested that behaviour was more to do with biology and, therefore, determined. He suggested that, as a result, rather than punishing the criminal as a deterrent, treatment was more likely to be effective (Muncie 2004). Lombroso and Ferrero were also interested in the ‘problem girl’ and especially in female delinquency.

One such contribution to this discussion was identified in the work of Karl Mannheim (1952). He was interested in how specific historical circumstances shaped generational values and beliefs and how they contributed to social reproduction in a period of social change. Youth, as a generation, is seen to help loosen the connection between chronological age and class in the youth phase. It becomes associated with ideas about social, political and cultural renewal (Davis 1990) rather than class conflict.

Most of these studies can also be described as a form of sociological positivism (Muncie 2004) and are concerned with explaining juvenile delinquency as some form of pathology or, at the very least, a dysfunction of social systems. Strain theory is a good example in that it takes as its starting point, similar to the Chicago School, the belief that there are ‘criminal’ and ‘noncriminal’ groups. Sociological positivism may reject biological differentiation but it still accepts and assumes that there remain criminals and non-criminals as a social fact.
